Brian came to the bar in 1970 and thereafter he practiced in maritime, commercial and equity matters at first instance in the Supreme Court and the Federal Court, all intermediate appellate courts, and the High Court of Australia. He has appeared in more than 30 cases in the High Court, including CIC v Bankstown Football Club (1997) 187 CLR 384, Hospital Products Ltd v USSC (1984) 156 CLR 41, Concrete Pty Ltd v Parrmatta Design and Developments Pty Ltd (2006) 229 CLR 577 and Maxwell v Highway Hauliers Pty Ltd (2014) 252 CLR 590. Until the abolition of Australian appeals, he also appeared before the Privy Council on five occasions, including Port Jackson Stevedoring v Salmond and Spraggon Pty Ltd (1980) 144 CLR 300 (Privy Council); see also Nissho Iwai v Malaysian International Shipping(1989) 167 CLR 219.
In 2017 he commenced a seven year term as a Deputy President of the Administrative Appeals Tribunal, a term which completed on 30 June 2024, and then he returned to the bar. As a result of that work, he has a broad experience in public law.
He took silk in 1982, after 12 years at the junior bar. He practiced as senior counsel from 1982 until 2017, and returned to full-time practice on 1 July 2024.
Courts of practice: Federal Court of Australia, Supreme Court of NSW, all Australian intermediate courts of appeal and the High Court of Australia.
Brian has taught Succession and Australian Constitutional Law for several universities in Sydney.
